【詞匯注解】

Mediation（調(diào)解）是非訴訟糾紛解決方式（alternative dispute resolution ）的一種，一般由第三方出面協(xié)調(diào)糾紛雙方（disputants）達(dá)成某種和解協(xié)議（negotiate a settlement）。通過調(diào)解能夠解決的糾紛，自然就不用走法律程序了。

The dispute was settled by mediation of the third country.
這場爭端通過第三國的斡旋而得以解決。

Litigation（訴訟）則是為了主張某個(gè)權(quán)利而將事情鬧上法庭的行為。起訴到法院，開始走法律程序，那么就是進(jìn)入了訴訟程序，也就是我們常說的“打官司”。
